When you use our mobile app, Foyer, this Privacy Notice should help you work out what we collect your data for and how we protect it for you. It is important that you read this Privacy Notice together with any other Privacy Notice we may provide on specific occasions when we are collecting or processing personal information about you so that you are fully aware of how and why we are using your data. This policy complies with the General Data Protection Regulation ((EU) 2016/679) and the UK Data Protection Act 2018 (DPA 2018).
It should also be read in conjunction with our End-User License Agreement and will form part of these.
Foyer may include links to third-party websites, plug-ins, and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy notices. When you leave our application, we encourage you to read the Privacy Notice of every website you visit. Foyer relies on third-party services which may set cookies essential for their functioning.

Foyer is an innovative mobile application revolutionising the theatre experience in the UK. Available for free download, Foyer offers users the opportunity to enhance their theatrical experiences by purchasing Smart theatre programmes. These cutting-edge programmes not only include traditional content found in a standard theatre programme but also feature exclusive video and audio content for a more immersive experience.
To access this exciting world of enriched theatre engagement, users are invited to create a personalized profile upon registration. By providing basic information such as their name, date of birth, and email address, users unlock a gateway to a new era of entertainment, seamlessly blending the traditional charm of theatre with the dynamic capabilities of modern technology. Foyer strives to redefine the way audiences engage with live performances, bringing a fresh and interactive dimension to the theatre scene in the UK.

We also collect, use, and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific App feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.
We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
2.2 How is your personal data collected?
We will collect and process the following data about you:
- Information you give us. This is information (including Identity, Contact, Financial, and Marketing and Communications Data) you consent to giving us about you by filling in forms on the Foyer App, or by corresponding with us (for example, by email or chat). It includes information you provide when you register to use the Foyer app, subscribe to any of our services, search for an App or Service, make an in-App purchase, share data via an App's social media functions, and when you report a problem with the Foyer App. If you contact us, we will keep a record of that correspondence.
- Information we collect about you and your device. Each time you visit and use the Foyer App will automatically collect personal data including Device, Content and Usage Data. We collect this data using cookies and other similar technologies. Please see our cookie policy below for further details.
- Location Data. We also use [GPS technology to determine your current location. Some of our location-enabled Services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by [disabling Location Data in your settings.
2.3 Third party links
The Foyer App, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. Please note that these websites and any services that may be accessible through them have their own privacy policies and that we do not accept any responsibility or liability for these policies or for any personal data that may be collected through these websites or services, such as contact and location Data. Please check these policies before you submit any personal data to these websites or use these services.
2.4 Who do we share data with?
Foyer uses third party integration apps (also known as ‘processors’).
Foyer will also use third party solutions for the purposes of delivering the service, manage payments and subscriptions, and for marketing. Foyer may also use third-party solutions for managing emails and push notifications. Kindly note that your preferences for receiving emails and push notifications may be amended on the Foyer app.

While your account remains active, we keep your information for no longer than is necessary depending on the purpose for which we are using it.
How long we keep your information will depend on the purpose for which we use it. While you are a customer of ours, we will only retain your information for as long as is necessary for those purposes.
Where required, we will use your information to evaluate or conduct a merger, divestiture, restructuring, reorganisation, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by us about our Service users is among the assets transferred.
We do not transfer your personal data outside the UK.
We use plugins on our website from social media networks such as Facebook, LinkedIn and Twitter. You can recognize these plugins by their logos. We also use plugins for the embedded video players which can be found on our website. Our plugins will not collect personal data about you, unless you click on these logos or videos. If you click on them, these plugins are activated and automatically transmit data to the plugin provider.
We do not have any influence over which data these providers collect from you and we are also not aware of the extent of their data processing. If you would like more information about their data processing, this can be found in the respective privacy policies on the websites of these providers.
2.5 Marketing
We use your information for customer insight and marketing purposes. In some cases, we will purchase information from third parties, but this is usually aggregated data and does not normally directly identify you. We will also keep a record of your social media account name and the information you make available to us via your social media account settings when you connect your social media account to ours, by messaging us, liking or following a page, tagging us in post or commenting on our posts.
We'll only send you marketing emails or contact you about our products or our related services if you've agreed to this. This may be in the form of email, post, SMS, telephone, or targeted online advertisements.
You may unsubscribe from our marketing communications by clicking on the “unsubscribe” link located at the bottom of our e-mails, or by sending us an email at lawrence@foyerap.co.uk.
2.6 Retention of Data
We keep your personal data no longer than strictly necessary for the following purposes:
- To fulfil the purpose for which your personal data was originally collected;
- As required by a specific law which we may be subject to;
- To manage any legal claims in relation to which such data may be required as evidence.
3. Storage and security of Information
We store the information you provide to us and the information we collect electronically in the cloud and computer databases. We own, maintain, and operate our computer servers containing our databases. Access to our computer servers is controlled by a series of security features.
Foyer is committed to keeping your personal data safe and secure.
All information you provide to us is stored on our secure servers. Any payment transactions carried out by us or our chosen third-party provider of payment processing services will be encrypted appropriately. Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Foyer App, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
Once we have received your information, we will use strict procedures and security features to try to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way.
We will collect and store personal data on your Device using application data caches and browser web storage (including HTML5) OR ALTERNATIVE MECHANISMS and other technology.
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator when we are legally required to do so. However, whilst appropriate measures are in place, we cannot guarantee that our security measures will not prevent a third party from unlawfully accessing or intercepting personal information stored or where an error may occur in the administration of our website. In consideration of this, we advise that you use caution whenever submitting personal information online.
3.1 What you can do to help protect your data
We do not store financial data. We will never ask you to confirm any bank account or credit card details via email. If you receive an email claiming to be from Foyer asking you to do so, please ignore it and do not respond.
If you are using a computing device in a public location, we recommend that you always log out and close the website browser when you complete an online session. In addition, we recommend that you take the following security measures to enhance your online safety both in relation to Foyer’s and more generally:
- Keep your account passwords private.
- Do not use the same password for multiple accounts. If your password becomes known, it may be used to access your other accounts.
- Never use your account password for an account that contains sensitive data.
- When creating a password, use at least 8 characters. A combination of letters and numbers is best. Do not use dictionary words, your name, email address, or other personal data that can be easily obtained. We also recommend that you frequently change your password.
4. Your Data Protection Rights
At any point in time during our processing of your data, you have the following rights. All requests in this regard may be made by sending an email to: lawrence@foyerapp.co.uk. We will also forward your request to relevant third parties mentioned above as required.
- Right of access – You can request a copy of the information that we hold about you.
- Right of rectification – You can ask us to correct data that we hold about you if it is inaccurate or incomplete.
- Right to be forgotten – in some situations, you may ask us to delete certain data we hold about you and we will always comply to the extent allowed or required by any applicable law.
- Right to restriction of processing – in some situations, you may ask us to restrict the processing of your data.
- Right of portability – You may ask us to transfer certain data we hold about you to another organisation.
- Right to object – You have the right to object to certain types of processing, such as direct marketing.
- Right to object to automated processing, including profiling – You also have the right to object to the legal effects of automated processing or profiling.
- Right to complain about how your Personal Data is being processed by us (or third parties), or about how your complaint has been handled – You can lodge a complaint directly with the Information Commissioner’s Office (ICO), the UK regulator for data protection, and with us (lawrence@foyerapp.co.uk).
- Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

Using cookies is a way for us to make sure that our website is continuously improved, meets your needs and can be used as a tool to optimize our marketing strategy. In order for us to do this, we place functional cookies to make the website function as well as marketing cookies which help us target the right people and show them advertisements.
